The United States Constitution gives Congress the power to impeach Supreme Court Justices and even the President. Some people have been trying to raise controversy over the 16th Amendment Bill to the Constitution. I would like to point out that as far as I know, most democracies grant their Parliament the power to impeach their Supreme Court Justices. Of course, this requires a two thirds majority vote in Parliament, the same super majority as required to change the Constitution. If a two thirds majority of Parliament can change the Constitution, then why cannot they remove Justices? Our Parliament should have the same powers and rights as most democracies around the world. Why are some people opposed to this? Perhaps they have their own vested interests. More importantly, the 16th Amendment Bill would restore our original Constitution of 1972 almost completely. It would undo all the illegal and unconstitutional manipulations of the military dictators from 1975, primarily by General Ziaur Rahman. Our Supreme Court itself has ruled that all of these changes were unconstitutional and made illegally. I find it very amusing that some of the more prominent people who have opposed this Bill are the very ones who helped draft our original Constitution of 1972. I for one want to return to our original Constitution. We must undo all the damage done to our Nation by dictators and usurpers. A nation that forgets its roots is a nation lost. We must go back to our roots and make a fresh start. Joy Bangla! Joy Bangabandhu! মার্কিন যুক্তরাষ্ট্রের সংবিধান তাদের আইনসভাকে সর্বোচ্চ আদালতের বিচারক, এমনকি রাষ্ট্রপতিকে অভিশংসনের ক্ষমতা দিয়েছে। আমাদের সংবিধানের ষোড়শ সংশোধনী বিল নিয়ে কতিপয় লোক বিতর্কের ধূম্রজাল সৃষ্টি করতে চাইছে। আমার জানামতে পৃথিবীর বেশিরভাগ গণতন্ত্রেই উচ্চ আদালতের বিচারকদের অভিশংসনের ক্ষমতা আইনসভার ওপর ন্যস্ত রয়েছে। এ অভিসংশনের জন্যে সংসদে দুই তৃতীয়াংশের ভোট প্রয়োজন, যেমনটি প্রয়োজন সংবিধান সংশোধনের জন্য। যদি সংসদের দুই তৃতীয়াংশ ভোটে সংবিধানে পরিবর্তন আসতে পারে, তাহলে সংসদে একই সংখ্যাগরিষ্ঠ ভোট কেন বিচারকদের অভিশংসন করতে পারবে না? পৃথিবীর অন্যান্য গণতন্ত্রে আইনসভাকে যেমন ক্ষমতা দেওয়া হয়েছে, আমাদের সংসদেরও সেরকম ক্ষমতা থাকা উচিত। কেন কিছু মানুষ এর বিরোধিতা করছে? সম্ভবত, এখানে তাদের নিজেদের কিছু স্বার্থ রয়েছে। তার চেয়েও গুরুত্বপূর্ণ ব্যাপার হচ্ছে, এই ষোড়শ সংশোধনী বিল আমাদের ১৯৭২ সালের মূল সংবিধানকে প্রায় সর্বাংশে পুনর্প্রতিষ্ঠিত করবে। ১৯৭৫ সাল থেকে মূলত জেনারেল জিয়াউর রহমানের প্রদর্শিত পথে যতো সামরিক স্বৈরশাসকেরা সংবিধানের ওপর অবৈধ অসাংবিধানিক কাটাছেঁড়া চালিয়েছে, তার সবকিছুই এ সংশোধনীতে বাতিল হবে। সংবিধানের ওপর সামরিক শাসকদের এ কাটাছেঁড়াকে আমাদের উচ্চ আদালতই অসাংবিধানিক ও অবৈধ বলে রায় দিয়েছেন। আমার কাছে খুবই কৌতুকপ্রদ মনে হচ্ছে একটি বিষয়। বিখ্যাত কয়েকজন ব্যক্তি, যারা এই বিলের বিরোধিতা করছেন, তারা নিজেরাই ১৯৭২ সালের সংবিধানের খসড়া করার কাজে যুক্ত ছিলেন। আমি আমাদের মূল সংবিধানে ফিরে যেতে চাই। স্বৈরশাসক ও ক্ষমতা জবরদখলকারীরা আমাদের জাতির যে ক্ষতি সাধন করেছে, তা আমাদের সারিয়ে তুলতে হবেই। যে জাতি নিজের শেকড়কে ভুলে যায়, সেটি পথ হারানো জাতি। আমাদের অবশ্যই আমাদের শেকড়ের কাছে ফিরে গিয়ে একটি নতুন সূচনা করতে হবে। জয় বাংলা! জয় বঙ্গবন্ধু!
