The first common pleas court in Marion Co. was convened in 1824. The first case on docket was The State vs. Eber Baker Apparently Eber was selling quantities of liquor that was less than a quart without being duly authorized. Mr. Baker pled guilty to the charge and was fined one dollar plus court costs. Eber Baker first moved to Marion Co. without the expectation of ever founding a town. He purchased land from Alexander Holmes and with that land came a house that two squatters had built. After removing the squatters from his land Mr. Baker made their house into a tavern. Later Marion was founded by him and Alexander Holmes. This tavern is probably the reason he got into a bit of trouble with liquor sales.
