The idea that majorities, via executive action and/or legislative action can/should rule despite the violation of the minoritys rights inherent in those actions and that the courts should not strike down those majority actions that violate the rights of the minority because it is representative of the will of the majority is akin to the 18th British argument that a Parliament is sovereign and can pass whatever law it sees fit, as enshrined in the Irish and later American Declaratory Acts. Do conservatives believe the majority is sovereign in America, or that every individual wherever in the world is sovereign, individually and as such maintains natural and civil rights that cannot be violated except as a result of due process, i.e. being justly convicted in a speedy trial by a jury of ones peers for committing an purposeful, actual crime wherein someones equal rights were harmed?
