The public trust doctrine and the Constitution of the State of Hawaii, which mandates that ALL PUBLIC OFFICIALS execute their duty to preserve the resources of the State (water in particular) for the present and future generations of this State. The Waita Reservoir is the largest freshwater reservoir in the State of Hawaii. It is filled via an old Sugar Cane diversion that blocked the normal Watershed course. Grove Farm has taken it upon themselves to promise Hawaii Dairy Farm 3 million gallons of water per day from the Waita Reservoir. That water is State Water that belongs to ALL THE PEOPLE of Kauai, and Grove Farm has NO right to promise it as a condition of their Lease with HDF. In addition, every public official has a Statutory and Constitutional Duty to preserve and protect historic Hawaiian sites, cultural resources and practices. If the public officials allow HDFs proposed Dairy to operate in Mahaulepu, they will be failing the people of Kauai, in violation of the Public Trust Doctrine. -The People of Kauai
