Yesterday the a five-man bench led by justice Tan Sri Abdull Hamid Embong unanimously held that there had been no procedural unfairness in the Federal Courts earlier decision not to grant leave. Abdull Hamid said that the threshold for the review had not been met. The Catholic Church had sought a review of an earlier Federal Court ruling in June 2014 to uphold the Court of Appeals decision to overturn the High Court decision that Catholic newsweekly Herald had the right to use Allah in its Bahasa Malaysia section. “Whatever the reasons given by the judges for the dismissal, the unfairness is a matter of perception where the public is concerned, Baru said.
