This is the latest memo on ICEs enforcement priorities. Much of this just puts in one place guidelines that were addressed by earlier memos. ICE will assign top priority to national security threats, convicted felons, gang members, and people caught in the act of crossing at the border or right after, near the border (within 100 miles). ICE will assign second-tier priority to those convicted of significant/ multiple misdemeanors and those who were not apprehended at the border, but otherwise entered/ reentered the US unlawfully recently (after January 1, 2014). ICE will assign third priority to those who are non-criminals but who have had their day in court, and have failed to abide by a final order of removal issued recently (after January 1, 2014). Third priority will basically mean that they could still make an argument that they should not be a priority because of other equities and then there would be a balancing. Under this revised policy, those who are not mentioned in these priorities (entered illegally prior to January 1, 2014, never disobeyed a prior order of removal, and were never convicted of a serious offense) are in a very good position to ask that their case be administratively closed as an exercise of prosecutorial discretion (and sometimes it would just happen without their asking).
