If he was Afghan, then surely the Geneva convention the UK sign does not cover him as he would have been classed as a civil fighter. Protocol II which the UK did not sign. Secondly, if he was not an Afghan then he still isnt covered as the terms of the Geneva convention only class soldiers of the nation we have declared war on. As far as I am aware he would invalidate his rights to the Geneva convention if he was a civilian bearing arms.....?
