To: File Date: 10-27-07 Re: Report - Back to Back Flats Today, 10-27-07, Polly told me to “be careful about “Dan [Bernardino] due to his anger management problems, which she has first hand experienced in the past and is currently experiencing. At present I am targeted beneficiary of his anger/hostility problems. He seems to have a problem with me training Polly on how to defend herself with legal tools - to address Dan’s chronic contempt of court ordered financial responsibility with regard to minor children’s basic child support. At 10:00 P.M. tonight I drove to pick up my cousin from work at Magic Mountain. I heard a pattering from the rear left of my car as I was driving. When I got to Magic I got out of the car and observed a big, bent nail lodged into my rear left tire. I moved it a bit and heard a hissing, so I left it in to keep it from leaking. While driving home my cousin also heard the pattering, then it suddenly stopped as we were driving. I deduced that the nail had dislodged itself and that tire going flat quick. Upon arriving at home, the back left tire was dead flat. My back two tires are brand new, just a few weeks old. This is the second flat I have had in the past four weeks or so. I found this to be a bit more than a curious coincidence. I reported the first flat tire incident to Sheriff Dunkel, the second in command with the local state militia. I never heard back from him. I also reported multiple instances of Dan Bernardino’s abusive verbal assaults on Polly and her kids. He even assaulted me. He attempted to have me taken prisoner for tutoring Polly on how to address by papering up his observed, objective acts, words and failures to act in light of, for example, hard cash owed pursuant to court order. I provided the local Sheriff some background on basic common law attempt and assault with verified Dan facts. Attempt: 1. The act or an instance of making an effort to accomplish something. 2. Criminal Law. An overt act done with the intent to commit a crime but falls short of committing the crime. Attempt is an inchoate offense distinct from the attempted crime. Under the Model Penal Code, an attempt includes any act that is a substantial step toward commission of a crime, such as enticing, lying …. Assault – Tort: 1. The threat of force on another that causes that person to have a reasonable apprehension of imminent harmful or offensive contact; the act of putting another person in reasonable fear or apprehension of an immediate battery by means of an act amounting to an attempt of threat to commit a battery. Assault – Criminal: 2. An attempt to commit battery, requiring the specific intent to cause physical injury. Battery: Criminal Law: The use of force against another resulting in harmful or offensive contact. Simple Battery: A criminal battery not accompanied by aggravating circumstances and not resulting in serious bodily harm. Simple battery is usually a misdemeanor but may rise to a felony if the victim is, for instance, a child or a senior citizen. Again, I never heard back from Sheriff Dunkel, Lee Baca or any other Sheriff. I was surprised about the local Sheriff’s failure to even acknowledge my letters to it, especially since Dan Bernardino even took some of the divorce business papers I instructed Polly on how to write to it in one of his attempts to have me taken prisoner. Right now I don’t know for sure if Dan drove a nail into my tire or not. Dunkel could have had his son Nick or one of his friends do it. Nick Dunkel was formally accused of raping, burning with cigarettes - and physically threatening her. He was also accused of physically threatening to my cousin’s family, whose unlisted personal information Mike Dunkel gave to his son Nick through the Sheriff’s computer access to federal citizens’ private files. I was informed that Dunkel was demoted because of it. Again, I do not know from any personal first hand eye-witness account that Dan Bernardino or some Dunkel connection flattened my tire, but I do know it is possible: A) Possible; B) Probable; OR C) Impossible Maybe someone else eye-witnessed it or even caught it on camera.
