To answer the question we were debating on this morning ( thanks mom for the info)...... YES, you can take the child across state lines in Colorado ( and pretty much every other state) without the other parents consent as long as these things apply to you 1. You are the sole guardian of the child and the other parent has NO custodial RIGHTS ( that does NOT mean if you are the custodial parent. The other parent must have NO custodial rights). If you do not have SOLE custody of the child / children then these rules apply if the parents have JOINT custody. You can take them across state lines if 1. You are only going to VISIT.....NOT TO LIVE If you are only going to VISIT, then.... A. You can take the child during the period that the child is suppose to be staying with you according to your court order. ( Again to VISIT, NOT TO LIVE) B. If you want to keep them during the time the child/children are to be with the other parent you MUST have that parents CONSENT. C. If the other parent does CONSENT, it is recommended ( so they wont scream kidnapped and get an Amber alert started when or if they get mad and want to do some sideways s**t) that they write out a letter and get it NOTARIZED stating that they give you permission to take the child/ children during their time AND include the DATES.
