Treaties that threaten the democratic legal system of the a country is an obvious breach of their constitutions. Democracy assumes the voice of each individual in the nation is given a chance to express their opinion in an open forum. A treaty must be, in many democracies, ratified by the sitting legislative body before it becomes law. The conclusion I draw from these arbitrator clauses that sovereign states are creating a crack in international law that recognizes sovereign states legal systems as the final word for their citizens. Representation in a foreign tribunal or in front of a foreign arbitrator assumes wealth and mobility. A gross limitation to the average citizen who must appeal to this process to protect their interests.
