We believe she has a legal right to be in the County and are trying to gather her legal status documents. She is a young mother who the FEDS requested an INS hold and Stanislaus County accepted it. (The local authorities do not have to but such a hold it is voluntary) She is arrested for a minor theft crime from a store. There is nobody available at INS this weekend to deal with this. Even if we show the local jail her legal documents it wont get the hold lifted. So we want to post a bail bond so she can be released to INS and then we can get INS to lift there hold since she is here legally. Easy right? Not so. Even if she is here illegally, she has a RIGHT TO BAIL on the criminal allegations. When we attempt to have her bailed out on the petty theft the Stanislaus County Jail REFUSES to accept the bail bond. Client has NO FUTURE COURT DATES right now but CANNOT post bond. She has 3 children at home without a mother. This is an illegal detention brought to you by our very own Stanislaus County Sheriffs office. In every other County posting bail for a person with an INS hold is routine. But my client languishes in jail because the left hand doesnt know what the right hand is doing here.
