Urgent!!! Calling on all State Representatives for immediate help. I was just served an hour ago 7/20/2013 by the State of Maine on behalf of Department of Health and Human Services requiring me to appear in court 8/21/2013 for what they call Maine Care Estate Recovery Program concerning $58,000 thousand dollars they say they are owed by my parent’s estate which they gave to me and where I live. The facts are these: I actually discovered this fraudulent program. I was having a bad time, I was in the hospital twice due to complication to sickle cell trait condition I have, and then immediately after that I was homeless hold up under a powerline three miles in the woods waiting to die. The experience was actually very peaceful, but God had other plans. My parents asked me to live with them and take care of them; my father who I was estranged from and wanted to reconcile had already decided to stop dialysis. My father died a few weeks later 11/5/2011, my mother died less than one year later 10/19/2012, both under my care. But before I came to take care of my parents I applied for SSI and ended up with Maine Care, and I can not tell you to this day how that happened. But a few weeks after my father died I was talking to someone and this is how I first heard about this recovery business. I went into DHHS and sure enough. So knowing soon the house was going to be transferred to me I canceled Maine Care. I told my mother about it, and she went in the next day and canceled her Maine Care also. My father and mother never knew of any contract or agreement or money owned to the state for services received by my mother. They were never informed. When my father blessed me, he extended his hands towards me and said, “Alan the house is yours, you do not have a care in the world.” Now the state is basically telling me he did not mean that, that I have to go back to the power line. And I am fine with that too. After that DHHS called my mother several times and tried to get her to sign back up and she refused until she and I both were assured on the phone she owed the state nothing, she then signed back up, that was January 2012. Now the State is reneging. I will never sign back into that program. My intention is to establish a lineage for my family name on this sight, and that can not happened if the State can fraudulently or otherwise take the property. I am seeking legislators to sponsor and co-sponsor, the more the better, a bill that will require DHHS facilitators to inform the public of the Recovery Program, and the terms and conditions one is under obligation. I am also looking for legislators to write a letter to DHHS and the Courts to ask them to hold all litigation for mine and all other State Claims from this time forward until the legislate is convened and given opportunity to look into and perhaps fix so as to protect the public from being held accountable to contracts they have no idea they have entered into with the State. I first found out about this in May 2013 sometime. I would have asked for help sooner but thought once I talked to them they would go away. Also the week before this started Senate President, Justin Alfond announced the legislature was back log and he had to make some changes in rules to get everything done on time. I knew there was nothing any of you could do at that time and did not think it would become necessary anyway, but it is now. So I would like as many as are willing to write a letter stating your intention to take this matter up in the legislature and soon so that I can use in court on 8/21/2013. Summary I need two letters, a draft bill and a letter to DHHS and the courts asking them to hold all cases until you have a chance to look into why DHHS does not inform people of the Recovery Program that threatens inheritances. What is needed: The information loophole needs to be closed, and facilitators of the program need to be required by law to inform people of the nature of the program. It is more than likely the framers of this program never intended to defraud the sick and elderly out of their property or their heirs from their inheritance. Please give my two Representatives first opportunity to sponsor the bill. My Representatives are Representative Jethro Pease and Senator Edward Mazurek Thank You, Sincerely, Alan Lowberg, a loyal servant to the State of Maine. Please share this post with your representatives in your area. We should have a good response in that way.
