WILDERNESS COMMERCIAL PHOTOGRAPHY PERMIT NEWS DEMYSTIFIED Having a legal background and a love of photographing wilderness, this whole controversy sparked by The Oregonians reporting on proposed rule changes for photography and commercial film work has peaked my curiosity. A link to the proposed rule and call for comments is linked here... 1.usa.gov/1Ct9VQT It amends section 45.51 of the currently active rule linked here... 1.usa.gov/1xpR8G6 The current rule requires permits only for certain types of still photography and the proposed change adds commercial film making and adds permit granting criteria. Here is a quote of the current rule... Section 45.51(a) A special use permit: 1. Is required for all still photography (sec. 45.5) activities on National Forest System (NFS) lands that involve the use of models, sets, or props that are not a part of the natural or cultural resources or administrative facilities of the site where the activity is taking place. 2. May be required for still photography activities not involving models, sets, or props when the Forest Service incurs additional administrative costs as a direct result of the still photography activity or when the still photography activity takes place at a location where members of the public generally are not allowed. So for those of us out to photograph the wilderness without props and actors, no permit should be required.
