Well members and fans of AFC Leopards Sc, you must have seen one #PatrickKeyonzoNgaira post here on Saturday night. His contention was mainly because NEC had belatedly moved to fill in the vacuum left by virtue of the suspension of 3 members of NEC him being one of them for financial improprieties. He saw this as a sealing of his fate and any chance of ever springing a come back to THE MOST COVETED NEC POSITION to continue with his escapades of #khubakanikhuliaku motto. Well I want to further kill his hopes here by stating his suspension was proper and legal and irreversible because: his suspension was done under section 3 subsection 7 which states that “Any member may be expelled or suspended from the club on grounds that his conduct has adversely affected the reputation or dignity of the club or that he has contravened the provision of this constitution.” Further section 3 subsection 8 states; “Any expulsion or suspension of a member shall be done on the recommendation of the National Executive Committee or by resolution of the general meeting of the club. Such suspension or expulsion shall be by a two-third majority of the National Executive Committee or of the general meeting of the club PROVIDED where a member is suspended or expelled by the resolution of the National Executive Committee, he shall have a right of appeal to the general meeting whose decision shall be final PROVIDED FURTHER that a member to be suspended or expelled shall have a right to address the committee or the general meeting at which his suspension or expulsion is to be considered.” As far as I am concerned none of the suspended members have appealed against their suspension, they actually rubbished it and thought they would continue to be club officials. I therefore consider the fact that the chance they were given to defend themselves at the AGM during the proceedings to suspend them was their chance of appeal which was overwhelmingly rejected. To make matters worse he and another guy suspended have engaged in acts of sabotage against the club they purport to support by going to KRA with fictitious info leading to KRA writing to club sponsor’s to withhold sponsorship funds that are meant to cater for players salaries. Such guys surely shouldn’t even step near the club. Secondly the club constitution section 4 of the constitution that deals with office bearers subsection 5 clearly states; “Any office bearer may be suspended or removed from office or expelled from the club in the same manner as laid down for the suspension or expulsion of members in Rule 3(7)(quoted above) and vacancies thereby created shall be filled by members of the National Executive Committee subject to the confirmation of any expulsion by the General Meeting of the club. NEC has mandate to replace those suspended members and they have done so by co-opting the 3 members as announced last week. Further section 6 of Nec that covers the operation of the Nec also reiterates same and I quote the whole section for avoidance of any contradictions: 6. The National Executive Committee 1. The National Executive Committee shall consist of all the office bearers of the club. 2. Any co-opted members of the committee may serve for a specified period or for the period that the National Executive Committee shall be in office. 3. The Committee shall meet at such times and places as the Chairman shall direct but shall meet not less than once in any three months. 4. The National Executive Committee shall have power to fill any vacancies on the committee as may arise in the course of the term. Any vacancy caused by suspension, removal or expulsion shall be subject to confirmation by the next General Meeting. Having said all that, I wish now to let Keyonzo and his accomplice Okumisi know that they have no other way of going around the constitution and members of the clubs decisions. I would also like to clarify to fellow members who always think every time there is a vacancy in NEC it’s #KHULIA time via campaigns and henceforth inducements that the clubs constitution does not allow for any other elections after the elections done at each NEC’s term in office. Any vacancies that arise either via death, suspension, expulsion or resignations have to be filled in by NEC. The campaign by Keyonzo and his brigade led by the so called self proclaimed opposition eater who thrives on handouts and shady deals like the ongoing jersey sales is all but null and void. If Keyonzo disputes all I have said, let him quote relevant sections of the constitution that save his filthy hairy ass. Furthermore, he made an attack of Madam Pamellah Lutta the iron lady, just because she had been co-opted into the NEC vomiting garbage that a sponsor cannot be in NEC. Well the last time I checked, madam Pamella wasn’t the sponsor, it’s Mumias Sugar Company who is the sponsor. By virtue of her position in Mumias Sugar co. it’s even best to have her on board to ensure the outright embezzlement that we witnessed in NEC will be kept in check.
