Why the Courts changed Police rights; A Progressive Design Whether youre convinced upon reading this it was the intent of the court or not to change the laws for the reason cited means little. The point is it was changed and because of that, the imbalance of rights weighs in favor of the police and state authorities. Almost up until the 1980s police were constitutionally held in balance and maintained the same unalienable rights all citizens did. But it was expected of all citizens to know and understand their rights. Given this reality of the time if a police used unconstitutional force against a citizen, the citizen had not only the “Right” to resist, but could kill the officer if he was forced to do so. So police were most cautious in there endeavors and personal demeanor when exercising their authority. So with all Americans on equal ground concerning their “Unalienable Rights”,along with their exercising their second amendment right, all for the most part was well. With the “Progressive” movement at full speed since the 1930s, citizens rights were eroded in small portions until the 1980s the Court took it upon itself to allocate ultra legal government issued rights above all the other citizens.”Qualified Immunity laws”now protected the police should they accidentally do harm, including murder to the public. Then the very same court proclaimed “Absolute Immunity” for itself should the public seek damages by the police for utilizing unlawful practices against the citizens. There were many more protective laws to follow these which only served to separate the public from the police and any unlawful acts on their part. So where are we today? Ferguson, Mo., Albuquerque, NM and New York City for starters. With the prior intervention of our courts and then the federal government programs which gave free military hardware to police departments throughout our nation weve been made the pawns in a very dangerous game being played by our government, both federal and local. With all their new laws in place made to keep the American citizen in check we as Americans now find ourselves as the “Prisoner” of our keeper, the new “Police State”. Id like to conclude by a show of example, an example of how is once was, and is now. Before the laws were changed to favor police authority, a man walking down the street and confronted by an “officer” (didnt matter who he worked for) who would then attempt to take his weapon although he was not suspected of any crimes could resist that officer even to the point of killing him for violating his second amendment right, without just cause. Now here remember what I told you before,all citizens were expected to know their “rights”, so if the citizen knew he hadnt committed any crime and the officer had not informed him he had, it was an unlawful seizure by the officer and could be met with due force. If the officer was correct, he could use the force he needed to subdue the person. Now today such an advent will never happen and if it were to, the courts would side with and favor the police simply because the courts no longer afford the citizen their “Unalienable Right” now if an officer (and today there are literally hundreds of thousands) were to stop you and for no reason other than you having a weapon and attempted to take it from you, you are NOT allowed to resist, he could use unlawful force on you if he desired, but you not him, and would be protected by his “Immunity”! Well assume the officer does use unlawful force because you asked why you were stopped, and after you get out of the hospital (If you get out), you sue and loose, then sue the courts for passing all those protective laws that saved the officer and find, once again you loose because as I told you, the courts have “Absolute Immunity” for themselves whereas no citizen can touch the courts that work for you? Make any sense? But thats a fact jack! Lets “Take it Back”! Heres an incident where the 19 year old was doing nothing buy filming police (Legal)and was told by police to enter someones apartment (Trespass) and was then beaten by the police for not doing so. Although the teen had a natural right to resist, our laws today prevent him from doing so.
