With the formation of Jubilee Alliance Party (JAP), the two primary parties in the merger between The National Alliance and United Republic Party, these parties which were used by the President and his deputy as electoral conduits to win a seat at the political high table, effectively stand dissolved (Section 11(6) of the Political Parties Act). In essence, the dissolution means that the Registrar of Political Parties is supposed to deregister these two political parties from his register. Section 22(3) of the Act further provides that where the deregistration is occasioned by a willful act (such as a merger, I suppose, as opposed to the grounds enumerated under Section 21), then persons elected as representatives from the deregistered parties cease to be representatives as envisaged by law. What this means is that what we have is an illegal (after the fact) executive and a huge portion of the legislature in office. But observation of the rule of law is not our strongest suit and so I dont expect by-elections anytime soon hinged on this unlawful act. PS: Hopefully, this is simply a legal observation and does not upset the Big Man in State House so much as to ask for my head on a platter.
