story on how I beat a ticket today. Hector Carrillo Ok here is the story. In aug I got a camera ticket for allegedly not coming to a complete stop on a red light turn. I received it in the mail a few weeks later. They wanted $495.00 Us dollars! That is nuts for any ticket. and plain unfair for such a small infraction. Think of the hardship it would cost the average family for a simple mistake. I decided to fight it. when i got to court they gave me 3 options pay the 495 and fight it or pay the 495 and get traffic school. or ask for community service and get no traffic school. They said here you can not fight it unless you post bail pay the fine . which is wrong we live in America. we are presumed innocent untill proven guilty. when it was my turn to plead I said not guilty and asked to be released on my own recognizance. the judge offered traffic school and said that was not an option. I told him the money was not an option. He made me wait till the end of the day and than granted it. my guess is he did not want anybody to see. as I watch i noticed that not one trial was fought. The police officer did not mention option 4. There was ladies there that the camera ticket was clearly not them. the officer told them that the best he could do was offer a reduced fine. WHERE IS THE JUSTICE OFFICER YOU CAN CLEARLY SEE IT IS NOT THEM. OFFICER TOLD THEM YOU PAY OR TELL US WHO IT IS. I TOLD HIM WHAT ABOUT THE RIGHT TO REMAIN SLIENT. HOW DARE HE TAKE MONEY OR FOOD OFF THAT LADYS WALLET OR TABLE. THIS LADY HAD SOLD THE CAR TO AN UNKNOWN PERSON AND BECAUSE SHE WAS TOLD THAT WAS HER ONLY TWO OPTIONS SHE TOOK IT. How many others has this happned to? while I was there I seen 4 cases of people taking the deal or just paying the fine. How is that officer protecting and serving the community? That lady is not to blame for the other persons actions. 495 come on reduced to 295. also people with lawyers all got there cases pleaded down to a 38300 or some code like that only a 35 dollar fine plus civil assessments something like 120 others that the cop did not have a good case were also pleaded down to that. cases where you could clearly see the person did not do that or was not the person at all. I think the pro-tem judge was in on it because it made the people feel as if that was there only option. I felt like i was being pressured into pleading and the worse part is if you fight it traffic school is no longer an option. when i got to court I asked the officer if he wanted to drop my case he said no. I told him I was going to fight it. he said ok thats fine . the judge asked him to show all of us fighting the ticket the video. I told him that is not me in the video. he was cocky and said we will see what the judge says. the video he showed me was of a white 2008-2012 toyota corolla making a right turn on merced headed north on puente in baldwin park. my ticket was making a right on to fransisquito coming east on romona. in a white 2002 nissan altima. i tried to point it out. Also you have the right not to be heard by a pro-tem judge. when asked f I gave up my right I said no and that pissed him off. because now he had to wait till they found a real judge that would hear my case. after that judge was done with his cases. i asked him one more time if he would drop it he offered the 33300 thing i said no. so we get to the judge i thank him for hearing my case and apologize for taking up some of his valuable time with this matter. The police officer starts by saying his name department and what he dose how long he has been doing it and when he was certified. 2006 by the way. he starts to present his picture evidence I get a copy of the pictures and a written certified statement from the company that took them. I ask for a few minuets to read it over which he grants. I get to reading and it says that it was edited chopped cropped and such. and that on that camera a tech checks it daily and fixes anomalies on it as needed daily. and that the pictures are copys that have been modified. certified copies. I bring up to the judge first who are they to cert the copies? no name of a person just a stamp. should not that have been done by a certified notary? we did not get that far because the judge explained the new law that governor brown just signed into law making hear say admissible in court. making that video and photos valid. Than he moves on to is it is it not me he said there is a chance it is not because i had my visor down but because the car is reg to me we would move cop plays the video I ask to see it cop says he already showed it to me. the judge is looking at the pictures saying yes that is you. Than i point out that is the wrong intersection and that my car is a 2002 nissan and that the one in the video is a toyota. he says but the plates match. i asked him to verify the plates in the video matched the plates in the photo they did not. before the judge said anything the officer asked for the case to be dismissed judge agreed and was still trying to catch on to what had just happened. I thanked him for his time and gave the officer an I told you so and told him no hard feeling on my case and started to talk to him about his oath and how he was wrong the judge was not having it and the officer was looking for the correct video so before he could find it I took off. case closed that is the third case i have fought and won out of many that I have lost. Know your rights respect law enforcement but do not let the power of the badge infringe on your rights.
