Article 370 was inducted into the Indian Constitution as a ‘temporary statute’. But today, it has become a permanent problem. The Article 370 stands as a stumbling block between Jammu & Kashmir and the rest of India. *ॐ~Guru Tattwa, Prarbdha, Moddism~ॐ* There were historic blunders committed by the then Interim Indian Government led by Jawaharlal Nehru. The Election Commission has announced five phase polls to Jammu and Kashmir Legislative Assembly with counting of votes on the 23rd of December. This staggered schedule for elections in J&K follow devastating floods in that state and a series of gestures by Prime Minister Narendra Modi reaching out to the people of Jammu and Kashmir. Narendra Modi’s J&K gestures have rattled the non-BJP political parties in that state with Omar Abdullah almost conceding imminent defeat while warning the people of the state of a BJP led government. The Kashmir separatists have been petulant and clueless on how to react to Narendra Modi moves even as yet another election boycott of desperation stares them in the face. The announcement of polls comes as Jammu & Kashmir is celebrating the 67th Accession Day on October 26th, today. In 1947, on this day, Jammu & Kashmir was integrated into the rest of India by virtue of a Constitutional document called Instrument of Accession under the Indian Independence Act, 1947. Maharaja Hari Singh, then supreme ruler of J & K and the sole designated authority of the then princely State, had signed the Instrument of Accession on October 26, 1947. The Instrument of Accession reads: “I Sri Hari Singh, ruler of Jammu & Kashmir State in the exercise of my sovereignty in and over my said State do hereby execute this my Instrument of Accession….The terms of this Instrument of Accession shall not be varied by any amendment of the Act or of Indian Independence Act, 1947…I hereby declare that I execute this instrument on behalf of the State and that any reference in this instrument to me or the ruler of the State is to be considered as including reference to my heirs and successors.” Reading the Instrument of Accession, two key points could be made. One, it was made clear in the document that there was no dispute in acceding Jammu & Kashmir into India. Second, Pakistan Occupied Kashmir (PoK) — which originally belonged to the princely State of Jammu and Kashmir — is very much a part of India. It can be recalled that soon after the partition of India in 1947, newly formed Pakistan intruded into Kashmir and illegally occupied 1, 20, 849 square kilometre area. Of which, Pakistan later gifted 42, 735 square kilometre to China and holds 78, 114 square kilometre under its occupation now, which is known as PoK. The entire territory of J&K, including that of the PoK and that under China’s occupation, belongs to India as per the Instrument of Accession. This very fact needs to be reiterated at a time when Pakistan makes fraudulent claims over Kashmir. Though the format of the Instrument of Accession for Jammu & Kashmir was the same as the Instrument of Accession signed by other Princely States annexed to India, there were historic blunders committed by the then Interim Indian Government led by Jawaharlal Nehru. Nehru had agreed that a ‘final decision” with regard to the accession would be ratified by the Constituent Assembly of Jammu & Kashmir. Accordingly, ‘a temporary provision’ was made in the Constitution of India for the ‘intervening period’. This is called Article 370. The Article — drafted in Part XXI of the Constitution — gives special status to Jammu & Kashmir. According to the Article, except for four subjects — Defence, Finance, Foreign Affairs and Communications — the Centre needs the concurrence of Jammu & Kashmir Government to apply all other laws.
