A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract and where all appeal instances available to the Applicant have been exhausted. *Pending Litigation All pending litigation shall in total not represent more than 50%of the Applicant’s net worth and shall be treated as resolved against the Applicant. * Financial Performance Submission of audited balance sheets or if not required by the law of the Applicant’s country, other financial statements acceptable to the Employer, for the last five (5)years to demonstrate the current soundness of the Applicant’s financial position and its prospective long term profitability. As the minimum requirement, an Applicant’s net worth calculated as the difference between total assets and total liabilities should be positive. * Average Annual Construction Turnover Minimum average annual construction turnover of US$ One Hundred (100) Million, calculated as total certified payments received for contracts in progress or completed, within the last five (5) years. * General Construction Experience Experience under construction contracts in the role of contractor, management contractor, orsubcontractor,for at least the last five (5) years prior to the application submission deadline, and with activity in at least nine (9) months in each year. * Specific Construction Experience a. Experience exclusively in the role of prime contractor, in at least one (1)contracts within the last five (5) years, that have been successfully and substantially completed and that are similar to the proposed Works. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Section VI, Scope of Works. b. executed during the period stipulated in 4.2 (a) above, a minimum construction experience, as prime contractor, management contractor, or subcontractor, in the following key activities: - Construction of foundations for 220kV or higher voltage transmission line tower 120.nos. in one year - Construction (erection) of 220kV or higher voltagetransmission line towers 120nos. in one year - Stringing of conductors 100 km in one year * Manufacturing experience of the proposed low loss conductor manufacturer Experience of proposed conductor manufacturer in manufacturing of low loss TACSR/AS conductor for a period of not less than ten (10) years * Manufacturing experience of the proposed insulator manufacturer Experience of proposed insulator manufacturer in manufacturing of insulators for transmission lines for a period of not less than ten (10) years.
