After Maharashtra, it is the turn of the Governor of Uttarakhand who has sought the opinion of the Constitutional bench in the Supreme Court, whether the Home Secretary is fit enough to communicate the desire of the new Government dispensation at the Centre. The Home Secretary may be much below the Governor so far as the Protocol is concerned, but so far as the functioning of the Union Government is concerned, the Union Home Secretary is the Chief Spokesman in the MHA. In government transactions it is an Under Secretary under whose signature normally written communications are transacted. It is all in the name of the President of India in whom all the executive powers of the Union Government is vested. The Union Home Secretary is the highest official, who is only next to the Minister of State (Home) and is within his official capacity to talk to a Governor of a State.
