By Stephan Kinsella: Sigh. I wish people would stop saying patent and copyright law are broken. They are not broken. They are serving certain special interests, and thats why they persist. And saying they are broken implies that some ideal or original IP system is what we really need, and that we used to have, and that we have deviated from it, and thus need to reform the system. The broken proclaimers never want to get to the root of the issue and explain that IP is totally incompatible with the free market and individual liberty and private property rights. People who argue for reform are basically saying that we need some IP law, but that it has gone too far. Their arguments are similar to the IP advocates, who also say that we need some IP law, and that there is some ideal amount of IP protection. Both of them oppose abolition, both favor some type of IP law, both seem to think that there is an optimal IP system and that we can know it, yet neither seems to know what it is or how to prove their claims.
