Courts Directs EACC To Investigate A School In Nakuru By Boaz Kipngenoh Tuesday, July 15th 2014 Ethics and Anti-Corruption Commission (EACC) has until Friday to file an investigative report at a Nakuru Industrial Court over alleged corruption at Nakuru Day Secondary school. Industrial Court Judge Byram Ongaya ordered EACC to file the report within seven days after the court established that there were possible irregularities in the schools procurement process. Justice Ongaya issued the orders last Friday after delivering a judgment in a petition filed by Catherine Wanjiru Wathoro against the Teachers Service Commission (TSC), Nakuru County TSC director and the schools principal over her irregular transfer and subsequent interdiction. Ms Wanjiru in the petition seeking to declare the transfer and subsequent interdiction as irregular submitted that the school principal Wycliffe Wafula connived with County TSC Director Agnetta Kitheka Mwikali to transfer her after she objected to the holiday tuition and irregular tendering. The Chemistry/Maths teacher, who was a member of the school tender committee, told the court that the principal awarded the tender to repair a school bus to a service provider who had not participated in the tendering process. The Industrial court observed that the transfer and subsequent interdiction was a result of the teachers objection to the irregular procurement award and the holiday tuition. The court considered investigative report by the Ministry of Education showing possible irregularities in the procurement process which was filed in court while the suit was pending. The court also noted that the school was possibly involved in irregular award of tender and undertaking of holiday tuition contrary to standing government policy banning holiday tuitions.
