Dear Alistair I hope you are well. Following on from my colleague Nadines previous email my landlord was happy to allow you to leave the property early if you wish. Your current vacate date is the 24/05/14/ If you could let me know at your earliest convenience your thoughts on this i can let the landlord know. I look forward to hearing from you soon Hi Daniel, My preference is to stay until the agreed leaving date. I could, of course, have arranged an early exit myself, by asserting my statuatory right to leave at two months notice. Along with most of my statuatory rights, I dont think this was mentioned in the lease, but fortunately for me these rights are, as the name implies, defined in statute not in contract. Im sympathetic to any needs the landlord has, these are tough times after all. Neither the Notice to Quit letter, which was an unapologetic and unmoderated threat of legal action if I failed to leave, nor the use of the word allow above, with its implication that I remain in my home or leave my home only at the sufferance of others, has done Clyde Property any favours in that regard. However, being inclined to generosity, I would consider an early exit if you could guarantee both the repayment of my deposit in full and the return of the credit reference fee, illegal in Scots law, that Clyde required from me at the outset of my tenancy.
