Taxi Drivers Galway Group Have lodged a formal planning objection, to the new planning application relative to the Coach Station, on the basis there is no proper inclusion of taxi rank space. Dear Sir/ Madam Reference: PLANNING APPLICATION NO 13/306 Proposed Development at Fairgreen Road Galway Permission for development to consist of the construction of 5 no. coach bays and 33 no. apartments (5 no. one bedroom; 23 no. two bedroom; 5 no. three bedroom) on first, second, third, fourth and fifth floors and all other site development works above and below ground is required to facilitate the completion of a mixed use development substantially granted permission under Reference Number 04/872: An Bord Pleanála Reference Number: PL 61.210830 that amended the planning permission granted under Reference Number: 448/02, for a coach station and associated and ancillary facilities on ground floor; facilities associated with and ancillary to the coach station at mezzanine level; office accommodation and apartments on first, second and third floors; and a basement car park and access ramp to the access road to Radisson SAS Hotel from Fairgreen Road. I write in connection with the above planning application. I have examined the plans and I know the site well. I wish to object strongly to the development. Setting out my objection on the grounds of access to and from Galway Coach Station and access to a Street Service vehicles ( Taxis ) by people with Disabilities and People with reduced mobility under current European Law EC No 1107/2006 ....... as and from 1st March 2013 Under the Current European law People with disabilities and people with reduced mobility who travel by Bus or Coach have the same rights as Air passengers to access all forms of Public Transport Including Street Service Vehicle (Taxis) within 10 meters of main Terminal Building. Since the provisions of a Taxi Stand were not submitted for the Coach Station in its first phase development, This must be facilitated in the above application. Currently over forty coaches enter and exit the Coach Station each day, Go-Bus / City Link / Galway Tour Company and some smaller companies who use it during the Summer season. Taking into account the two main carriers Go-Bus and City Link provide a daily services Galway - Dublin –Galway. Passengers number entering and exiting the Coach Station is between 6000 and 10000 per week.. The provision of the Taxi Stand at upper Fairgreen road does not meet requirement on the above European Law, due to the distance a person with reduced mobility has to walk to access the nearest appointed taxi. • European Law. 5. L EGAL ASPECTS 5.1 . Legal base The legal base for the proposal is set out in Article 71 of the Treaty establishing the European Community, to which the co-decision procedure applies. 5.2 . Choice of instrument The main objective of the proposal is to ensure an adequate level of protection of bus and coach passengers, including persons with disabilities and reduced mobility. The rules established by the present proposal should be applied in a uniform and effective way across the European Union. A regulation that is directly applicable appears to be the most appropriate instrument to ensure the most coherent application of the rules in all Member States. A regulation as a legal instrument has already been chosen by the Community in order to protect the rights of air and rail passengers. In order to achieve enforceable and equivalent passenger rights for bus and coach transport, a regulation has been deemed the most appropriate instrument Abbreviations PRM: Person with Reduced Mobility. WCHR : Passenger who can move slowly, climb stairs, but requires a wheelchair for long itineraries in the terminal. WCHS : Passenger who can walk only a few steps. BLND : Blind or eyesight impaired passenger. DEAF : Deaf or hearing impaired passenger • There must be a “special” park space for taxi’s carrying PRM, so that these people may use the nearest access point to the PRM contact areas within the terminal facilities. Taxis equipped for the transport of PRM should be available at all times.
