GET ATHLETE SPONSORSHIPS IN WRITING: I have written about this before, but maybe a refresher as in most industries you cannot rely on “I sent you some product, please post about me” as the so called “Agreement”. Maybe the overwhelming task of writing a Sponsorship Agreement can the reason but it’s no excuse to even attempt to give product to someone without having them agree/sign something in return. The internet has so many examples of Agreements that can be customized to fit your needs so once again NO EXCUSE to not having anything in writing. Why Should A Contract Be In Writing? 1. It is a clear record of the mutual agreement between the parties. 2. It brings certainty to the relationship and signifies its importance. 3. It is good for risk management. It avoids relying solely on memory as to what was actually agreed. 4. The record of the agreement survives even if those who negotiated it have moved on. What Should Be Included In A Contract? From the athletes point of view, there are four general things that the contract must provide: 1. Understanding. You must be able to understand what the contract says. It should be in plain English. If you dont understand it, then ask questions. Dont sign if you dont know. 2. Fairness. Equal benefits to both parties. 3. A clear record of your obligations. Be in NO doubt whatsoever as to what is EXPECTED of you. 4. A clear record of other partys obligations. Make sure that the contract specifies what you expect the other party to do. Without a contract, it is completely UNPROFESSIONAL to call athletes out in a PUBLIC FORUM for lack of promotion from a specific event. They are not mind readers. When Companies send product “thinking” that they are going to be getting in return promotion of some sort, you cannot put blame on the athlete if they promote your product in another forum/social media or event other than the one you had intended them to do. If you let them know by specifying it and they agree to it then by all means, post away otherwise contact the athletes individually and have a conversation with them and get it in WRITING. #ProtectionForBothParties
