Hajj fiqh continued: Q. I am very scared of the outbreak of Ebola and all of the other diseases that are now rampant, and I have been advised to wear a face mask during the Hajj season. Will my Hajj be accepted if I wear such a mask? A. Alhamdulillah. Firstly, realize my dear sister in Islam that nothing occurs except with the will of Allah, so put your trust in Him, and then take adequate precautions and make dua that Allah protect you. Secondly, the issue of the modern surgical mask and whether it violates the state of ihram is one in which there is a difference of opinion. Some modern scholars have said that such a mask is completely and totally permissible; others have said that it is allowed for men without a penalty (since according to one opinion there is no penalty for men covering their face); and a third opinion claims that for both genders, there will be a penalty. I believe that the third opinion is the safest, and Allah knows best. Thirdly, there is a common misconception that the factors that violate the ihram are always prohibited, and doing them almost invalidates the Hajj! This is a gross misunderstanding. The Shariah is not unreasonably strict. In an authentic hadith, our Prophet (SAW) ordered a Companion to shave his hair (which is typically a violation of the rules of ihram!) because of a medical issue, and told him to pay the expiation for it. Therefore, one may contravene the of the prohibitions of ihram for a legitimate reason, and there is no doubt that the scare of modern diseases is a legitimate concern, and that wearing a surgical mask is a legitimate protection against such diseases. Hence, you may wear such a mask, and there is absolutely no sin on you in doing so. However, you should pay the kaffarah (expiation) for it. You may choose any of these options: sacrifice an udhiyya; fast for three days; or feed six poor people an average meal. This last option is the easiest: you may purchase six meals from any restaurant in Mina, and then give it to those whom you feel are poor (and to find such people is not difficult in Mina!) And Allah knows best.
