Three brave Nebraska landowners who are fighting Governor Heinemans abuse of power on pipeline routing and eminent domain will head to the Nebraska Supreme Court on Friday, Sept. 5 to defend their lower court victory. We need all of the Pipeline Fighters to turn out in force and show their support. This is the court case that stopped Keystone XL dead in its tracks. After our victory at the lower court, the U.S. State Dept. and Obama administration announced they would postpone any decision on the pipeline until this case runs its course. Join us to stand with landowners fighting KXL at the Nebraska Supreme Court. The landowners — Randy (Stand with Randy) Thompson, Suz Straka and Susan Dunavan — and their attorney Dave Domina will argue that Judge Stacy ruled correctly, when the lower court found the law (LB 1161) passed by the Nebraska legislature to give pipeline routing authority and eminent domain powers to the Governor — and ultimately to a foreign corporation to condemn farmers and ranchers land for the pipeline — was unconstitutional. SCHEDULE OF EVENTS FOR FRIDAY, SEPT. 5: • 8:00 a.m.: Arrive to start lining up to get seats inside the Supreme Court hearing room, located on the 2nd floor of the Nebraska State Capitol building. • 9:00 a.m.: Nebraska Supreme Court hears attorneys arguments in Thompson v. Heineman; our case is the first on the docket for the day. • 9:30 a.m. (approx.): Pipeline Fighters exit the courtroom after our hearing ends, and we all head to the rotunda (also on the 2nd floor) for a Press Conference with the landowners and legal team. • 5:00 p.m. - 8:00 p.m.: Concert Rally at Vega in Lincolns Haymarket district, featuring landowners and legal team, with live musical performances from local artists. Please do not bring any NO KXL or other signs; they will not be allowed inside the courtroom. Wearing a Pipeline Fighter or similar t-shirt is OK. Other courthouse rules: no food or drink, no photos/video, no hats/caps, and cell phones must be turned off. We have arranged for folks who dont get inside the Supreme Courts small hearing room to be seated in an adjacent overflow courtroom with live video. We also invite everyone to join the landowners and legal team the evening of Sept. 5 for a Concert Rally — from 5:00 to 8:00 p.m. — at Vega in Lincolns Haymarket district. The event will feature live performances from local artists who performed on Stopping the Pipeline Rocks, the benefit album we recorded inside the solar-powered barn built by volunteers directly in the path of Keystone XL last summer. RSVP to attend the post-hearing Concert Rally in Lincoln, 5-8 p.m. on Sept. 5. There will be a $10 donation cover charge at the door, with proceeds going to help pay lawsuit costs (and to pay the artists who will be performing). Be sure to bring another $10, to get your copy of the Stopping the Pipeline Rocks benefit album and concert film on DVD+CD. We need Pipeline Fighters to come out and stand with our brave landowners who are fighting TransCanada, Keystone XL, Gov. Heineman and corrupt Nebraska lawmakers who thought they could override our states constitution as a favor to their Big Oil backers.
