I am publishing below an extensive investigation by the Dallas Morning News regarding an historical and detailed account of just why Texas does not punish owners of nursing homes which provide dangerous and sometimes shocking living conditions to the elderly and the disabled. It is easy to simply say that weve always had this problem and throw up our hands. But as the report clearly indicates--back with Attorney Generals John Hill and Jim Mattox were in office, they took action against nursing homes which were deplorable. This is a radical departure from our current Attorney General, Greg Abbott who has turned the other way. Lets be very frank about this situation: the Texas system is completely broken--and the nursing home lobbyists who have injected hundreds of thousands of dollars into campaign officials of state office holders--who then subsequently watered down Texas regulations--is a major reason. Another is the so-called tort reform measures enacted years ago which limited damages in these kinds of cases--thus--making it much more difficult for families to find plaintiff lawyers to sue these institutions. In other words--it is a combination of factors--gutless state office holders--and other who sold out the people of Texas to nursing home lobbyists--and fracturing the civil justice system--which has now earned Texas the dubious distinction of being 49th in the quality of nursing homes for the elderly and the disabled. Bob G Jackson--you were right--there are a multitude of systemic reasons why people are allowed to die in Texas nursing homes due to abuse and neglect--and those places are not shut down...
