In the news. This is a police tactic that is becoming more frequent: There is a good chance if you are stopped while driving, the police officer is going to demand to search your vehicle. This is a more common thing for young drivers who dont know their rights. You need to know this. They cannot demand to search you or your vehicle because of your 4th Amendment right to unlawful search and seizure. If you are stopped for whatever reason, and the police officer demands to search your vehicle, say no. Be brave. They have no right to do this, and further, they cannot obtain a warrant to do so either--theres even a chance the office might lie and say he can. An extreme example of this is, two days ago in New Mexico, a man was leaving a shopping center, and did what is called a rolling stop at a stop sign. In other words, he slowed down to a near stop, looked both ways, saw no traffic and went on. A police office stopped him and asked him to step out of the car. The officer thought the man was standing funny, so he used his police dog to do a sniff search of the mans car. The dog went woooh and rolled his eyes, which was enough for the office to forcibly take the man to a local hospital. They conducted no less than 5 body cavity searches, including one where they forcibly put him under sedation and used a camera probe (not sure what that looks like--dont want to know). In the end, they found nothing. The man has now hired a civil rights attorney and is suing. To make matters worse, the hospital is sticking the man with a hospital bill--unbelievable.
