Assuming that while it was holstered it had the safety on, how did he manage to get it off while presumably being beaten. When someone is banging your head on the pavement, he must be sitting on your chest; if your arms are not pinned you can fight back, and if they are how do you reach a gun at your waist, with the legs of your supposed assailant blocking you? On the other hand, suppose Z had his gun out before the scuffle. Then it would it be Martin who was feeling threatened? A loaded gun is a lot more menacing than a bag of Skittles."
