Memorandum Presented to His Excellency, the President of India by top leaders of Bharatiya Janata Party, Odisha To His Excellency, Sri Pranab Mukherji Honble President of India Rashtrapati Bhawan New Delhi Your Excellency, While welcoming your esteemed self to the land of Lord Jagannatha, we take this opportunity to put before you certain facts, that have taken the State by storm in the last few days. The Honble Governor of Odisha summoned the Odisha Legislative Assembly with the Calender of Sittings of 26 days. The winter session of the Odisha Legislative Assembly started on 20.11.14 but unfortunately till date i.e. 29.11.14 not a single business of the House has been transacted. We are to inform you that the Chit Fund scam in which lakhs of innocent citizens were looted of their hard earned money, amounting to thousands of crores which came to light two years back. After much demand from the general public, the State Government instituted a Crime Branch investigation. The Crime Branch while finding Owners/Directors of Chit Fund Companies guilty, completely exonerated the politicians involved in it. Subsequently, Writs were filed in the Supreme Court of India and after a thorough hearing the Honble Apex Court ruled that :- 9. It is unnecessary to multiply decisions on the subject, for this Court has exercised the power to transfer investigation from the State Police to the CBI in cases where such transfer is considered necessary to discover the truth and to meet the ends of justice or because of the complexity of the issues arising for examination or where the case involves national or international ramifications or where people holding high positions of power and influence or political clout are involved, “ 15. In the peculiar facts and circumstances of the case, looking at the nature of the allegations made and the mighty people who are alleged to be involved, we are of the opinion, that the better option of the two is to entrust the matter to investigation by CBI.”, 30 (5). That investigation so far conducted reveals involvement of several political and other influential personalities wielding considerable clout and influence, “36. Transfer of investigation to the Central Bureau of Investigation (CBI) in terms of this order shall not, however, affect the proceedings pending before the Commissions of Enquiry established by the State Govt or stall any action that is legally permissible for recovery of the amount for payment to the depositors.” and “40. The writ petitions and T.P.(C) No. 445 of 2014 are disposed of in terms of the above directions. No costs.” From the above comments of the Honble Supreme Court of India, it is clear that the Writs were disposed of recommending a CBI enquiry. The ongoing CBI investigation, has led to the interrogation and arrest of several politicians of the BJD, including a sitting MP, MLA, ex-MLA, influential media house owners, journalists, businessmen, brokers and others, involving thousands of crores of innocent poor peoples money. Hence, it is understandable that the people of Odisha are extremely aggrieved and have great expectations from their representatives in the State Legislative Assembly, where they hoped no power could stop the truth about the chit fund scam from coming to light. Unfortunately, ten days have passed and not for a moment could the issue be raised, as the ruling Party has been constantly disrupting proceedings from question hour itself every day. To the extent that whenever the Opposition tried to raise the issue, they were prevented from doing so. Moreover, the Honble Speaker has ordered, on the advice of the Advocate General, that the Chit Fund issue cannot be discussed as it is Sub- Judice. The Honble Speaker, acting like an agent of the BJD, has displayed an openly partisan attitude and is operating under directions from the treasury benches. This is a deliberate attempt to stall the proceedings of the House and throttle the voice of the Opposition. There is a complete democratic deadlock and the Legislature has been paralysed. It has been noticed over the last few years, that the Executive too is being prevented from functioning in the interest of the people in an independent manner. Both the Legislature and Executive have been brought to a standstill. The transaction of business of the House is governed only by the Rules and Procedures and not the advice of the Advocate General. We pray before you, to kindly intervene in the matter and restore not only the dignity of the House but also the Rule of Law and due process of democracy.
