Rob has totally misunderstood a part of the anti-tenure lobby. We are saying, why not award the tenure at the point where you employ the faculty? ok, you may want to put him/her on probation as per other jobs, perhaps 3 months, 6 months. But a probation period, of 6 years+ as it stands now is ridiculous. This puts the new-hire (yes, before you get the elusive hire, you are still a new-hire) at the whims and mercy of the tenure process. And we have seen in many instances, how that can go wrong.
