Some of you might have heard Augustine was offered a plea to involuntary manslaughter and aggravated battery. He has agreed to take this plea. The plea/sentencing hearing is scheduled for Tuesday, July 22, 2014 @ 1:30.- this hearing is open to the public. Our family is very saddened and upset that he was offered this plea against our wishes. The most upsetting thing is knowing Augustine will be released on Tuesday. This is a sad world that we all live in to know that someone only gets 4 1/2 years for brutally murdering ( stomping, bashing, and kicking )our brothers head in. The District Attorney offered this plea knowing his violent history of brutal attacks on the Native Americans in 2009. Along with knowing our families wishes to go to trial. The total exposure for this horrifying lenient plea is 4 1/2 years. Augustine has served just about 2 1/2 years leaving a balance of 2 years left on this sentence. The DA already giving him a slap on the hand for murder, then decided to give him the remaining 2 years on supervised probation instead of giving us the chance to argue for prison. Its not only a slap in the face to us. It shows Johns life did not matter. It also shows how much they do not care about our community. Augustine will get out and hurt/kill someone again. To those that want to believe Augustine is innocent, please believe what you would like. We all know what kind of violent person he is. We all know HE DID KILL JOHN. This he cannot dispute!! He just got lucky. If he was completely innocent like some would like to say, then he would not have accepted ANY plea deal. He would have taken it to trial. You dont accidently stomp someones head in and not expect them to die. You beat someone that badly you should know that you have either, hurt them beyond repair or killed them. In his statement Augustine said, I know when to stop. no you DONT. John was proof of that. You complain about being locked up for two years. When you STOLE our FOREVER with John. We would give anything to have him back after only two years. The others involved also got lucky ( Natalie, Michael, and Jesse) You Tazed him, You kicked him, You beat him with a bat and a tire iron, You tried to force people at the party NOT to call 911 when he was dying. Several people named you all. You all laid a hand on John that night. You are ALL responsible. 4 1/2 years is NOT justice and those walking around free with nothing is not justice. Our family has been quiet this whole time over fear of hurting Johns trial and now we are done being quiet. John deserves someone to be loud for him and to be his voice. We will never stop fighting for him!!!!!
