Subject: LIQUOR LICENSE ENQUIRY Dear Ed In accordance with the Liquor Act in Gauteng the definition of “SALE OF LIQUOR” is as follows: “Sell” includes exchange or keep, offer, display, deliver, supply or dispose of for sale, or authorize, direct or allow a sale” The answer to your question therefore is that you may not under any circumstances keep liquor at your premises or offer the sale of liquor for sale to any person even in a disguised manner. The Act is written in such a manner that it covers all loopholes and if your intentions were valid to sell liquor in this manner no person would have to apply for a liquor license. The same applies in Cape Town and this kind of practise is not permitted in terms of any Liquor Act. My advice to you therefore is to refrain from this practise, irrespective of how small your premises are and whatever kinds of liquor your wish to provide. The minimum size for an on-consumption facility to be licensed in the Gauteng Province and in accordance to the Gauteng Act is that the premises should be at least 30 square metres in size for on-consumption, excluding the storage and office space.
