The Honorable Attorney General Jim Hood Dear AG Hood, I am the recipient of an anonymous mailing that contained a copy of a letter from you, a copy of House Bill 874, and 2 whereas resolutions about Ike Brown and William Cateledge. I am writing to request clarification of your letter to the Honorable Rita Martinson that is dated 6/23/2014. I recently joined the Mississippi State Democratic Party’s Executive Committee, which is a volunteer organization, and am unable and unwilling to do background checks on my fellow 89 State Executive Committee members and 30 County Executive Committee Members to discern if they have been “convicted of bribery, perjury or other infamous crime:… . Section 1-3-19 defines the term” infamous crime” as “offenses punished with death or confinement in the penitentiary,”” and must be removed from the Executive Committee because of your official opinion letter. I am therefore writing to you to make the following suggestions for clarification in our current executive committee membership conditions: 1. The County and State Executive Committees should be able to request a copy of their volunteers voter registration card from their membership to be assured that they have not been convicted of a felony against the State of Mississippi that caused them to lose their voting privilege. If they can still vote, then they can volunteer onto an Executive Committee, is that not correct? 2. Change the law so that the volunteers of County Executive Committees will be required to register (& update changes in) their members just like the Municipal Executive Committees. This public listing would also make sure no Executive Committee Members are ever employed as poll workers because the Election Commissioners would definitively know who has volunteered to serve on their County Executive Committee. If the County Executive Committee does not register their members, then they cannot endorse county candidates for the ballot, just like the Municipal Executive Committees. In closing, I am not willing to participate in “felon hunts” of my fellow volunteers on the State Executive Committee and on my County Executive Committee. I think that if the law forbids some people from volunteering, then the law should supply the remedy to detect who cannot serve, and prevent membership on the Executive Committees, not place the detection and expulsion methods upon volunteers.
