The North Dakota Supreme Court heard testimony in a case that could change the constitutional right for police to require a breathalyzer test. The case dates back to 2013 in Bismarck. The officer pulled over a woman and went through tests to determine if she was drunk. He then asked for a breathalyzer. She refused and was charged with a criminal offense for refusal.
