The role of the First Amendment and how it relates to the speech of those who serve as public employees is in the news today. This area of law is complex. It has evolved over many decades of cases brought by public employees, such as teachers, law enforcement officers, college professors, and other employees who were either fired or suffered adverse employment actions by government employers. As a threshold matter--an inquiry into whether certain speech is protected by the first amendment is premised into whether government action has impacted on such speech--such as when a government employer has fired an employee. To my knowledge--none of this is applicable with respect to the issue of the Human Rights Ordinance and certain utterances by a member of the San Antonio City Council. This is not a first amendment issue.
