This Tuesday, February 4th, our Attorney General, Mark Herring will be in court, NOT defending the Virginia Constitution as he swore to do, but will be in U.S. District Court in Norfolk joining plaintiffs in opposing Virginias Marriage Amendment to the Constitution which was passed in 2006 by 57% of Virginia citizens. Please consider coming out to the Courthouse in Norfolk and stand for up for Virginias Constitutional principles with The Family Foundation and several other pro-traditional marriage groups. The opposition will be out in force and we need to show the media that Virginians believe in the rule of law and traditional marriage. Please plan to be at the United States District Courthouse in Norfolk this Tuesday, February 4th at 9 am. The Courthouse is located at 600 Granby Street in Norfolk, VA 23510. Friends, a dangerous precedent is being set when the Attorney General, whose sworn duty is to defend the Constitution of Virginia, literally joins the other side based on his own philosophical beliefs, preempting the Supreme Court in his decision to do so. Take note that this is not an ordinary statute that can be overturned by a single General Assembly session. It can only be undone by the same Constitutional process by which it was enacted. A resolution to amend the Constitution must be passed by both houses of the legislature two years in a row with an election in between, then it must be passed by the voters the following November. If Attorney General Herring is allowed to choose which parts of the Constitution or statutes he will defend what could be next: our Constitutional eminent domain protections; or our right to work laws; how about the second amendment?
