what a WEIRD day... truly... we were the last jury this morning to be called... we were all tight as a unit of 7 before even going up... two other older gents... one older woman (all around my age) and a 37 year old female nurse, a 40 year old country boy and a 20 year old nurse... and so we go up FINALLY and then sit in the jury room... and sit and sit... finally get sat in our chairs... and its a domestic violence case... alleged strangulation battery on mom trying to stop it (with a hammer) battery on dad trying to stop it... (with a hammer) (edit) yet the defendant was the only one with CLAW MARKS on him... the dad had no injuries and the mom didnt even testify (see below) but his defense lawyer was TERRIBLE!!!! ... we all spoke of how incompetent she was.... she wasnt born in the USA, had a broken accent and just didnt follow procedures AT ALL... there were AT LEAST ten sidebars to where she was called out for not asking questions IMPROPERLY... objection sustained deer in headlights look SIDEBAR over and over and over... heck it was lunch and werent even done with the first witness... after lunch the bailiff said were probably looking at 7 or 8 oclock... suddenly me getting a paid day off wasnt so great... i get off at 4PM LOL... so but things got rolling and it was over by 6:30pm... i wanted to be the jury foreman, but didnt want to ask for it... then it just happened by bailiff suggesting it, since i was writing down everyones name... but i was only doing so, because everyone started asking each other our names... WEIRD... we spent all day together, cracking up, talking about everything under the sun, but never exchanged names... anyway, so i said o.k. after everyone agreed and i suggested we all write down what the think, and IF IF we all agreed on a verdict, then we can then go over WHY and then submit... and if we didnt agree, then wed begin to go over out notes.... i took 9 pages of notes~ lol... FOR REAL... not fooling around~ and WE ALL had not guilty... then i went over why we each thought so, to give each person shipowner on why... letting everyone be heard, etc.. BTW, as we were leaving the jury box, the judge called for the 40 year old nurse to stay behind as an alternate... so she was told she could leave, but she stayed and joined us afterwards and was SO HAPPY we said innocent... she also totally agreed... ZERO evidence... VERY poor argument by the States Attorney, even though the defendants attorney was incompetent... so when i say it was a WEIRD DAY, i mean it... lol... they framed his arse up, as SHE went over with a stick to hit him, busted HIS lip with her fist, hit HIM in the back with a hammer, they both had scratches and HE got arrested... lol... INSANE!!!!!!! he went into tears when they read the verdict... he/they all were dirt poor... VERY humble people... but her side was NOT GOOD... and you could tell... the mom, who allegedly was also hit by him with a hammer???, uh yeah/no, she didnt even testify... the dads testimony was i have a bad memory, i dont remember a lot of stuff... no marks, no nothing... the defendant is leaving and bleeding and goes to a neighbors and so the mom/dad and girlfriend who all lived a 100 yards away went over and took the stick she came over with (by herself) and the hammer that was already there, and took it... so neither was found by the deputy... so how did his back have those claw marks???? the house was under repair... the defendant was working on the mobile home you see BOTH mobile homes were her families... they put one in his name when they lived together (again only 100 yards apart) but they put it in his name because their son (her brother) hurt some people in a car accident and so to not get sued, put one of the houses in the fiances name... then asked him to put it back in theirs later... and he did... and they then split up, and as they are arguing over the phone, he makes the comment that because of some illness (or something) he could get the house put back into his name.. and so shes PISSED and comes over and attacks him... the poor dude was taking care of her son... NOT HIS... they had two together, but after those two, theres a younger one thats not his and that one is living with HIM... lol... Jerry Springer (Polk County Style????) i was ELATED when i saw we all said INNOCENT... he started crying, and i gotta admit, it was a lil emo for me too, seeing him... i mean, they were trying to ruin his life... so it was a VERY rewarding experience and they all were complaining beforehand about having to be there today, as i was the only one who was happy to sort of have the paid day off and do sort of a FIELD TRIP... :P ... but i gotta say... we were ALL happy and i think theyll look back on today and remember it forever... the 27 sidebars, etc... lol... BTW, i would have ran circles around BOTH lawyers... i missed my calling, but i think you have to be smart & junk to be a lawyer, so maybe that would have slowed me down... oh, and pass some (BAR) test :D ... anyway, what a great day... that one will be hard to beat~ thanks for reading~
