A case challenging the cancellation of the Sh24.6 billion laptop tender has been referred to Chief Justice Willy Mutunga to constitute a three-judge bench. High Court judge Weldon Korir said the case filed by Olive Telecommunications raises serious constitutional issues, which need to be handled by more than one judge. The judge further extended orders suspending the decision by the Public Procurement Oversight Authority to cancel the tender. The Public Procurement Administrative Review Board cancelled the tender awarded to Olive Telecommunications to supply 1.2 million laptops saying the company lacks the financial capacity to carry out the project. It ordered the government to initiate a fresh tendering process. The board ruled that only Hewlett Packard Europe and Haier Electrical Appliances of China could participate. It gave the Ministry of Education 45 days to review the offers and complete the tendering process. The tender was awarded by the ministry of Education fro the supply of laptops to class one pupils in public primary schools.
