APPEAL FILED IN SUPREME COURT TO REINSTATE ELECTION PETITION /////////////////////////////////////////////////////////////////////////////////////////////////////////////////// On 5th August 2014 I filed my appeal in the Supreme Court to review the decision of the National Court in Madang dismissing my election petition. I filed the petition disputing the election of Minister of Petroleum & Energy Nixon Duban in 2013 By-Election for the Madnag Open Electorate. The Trial Judge dismissed the petition after Dubans lawyer moved a motion for summary judgement (judgement to dismiss the entire case) after I failed to appear at the trial date on 25th July 2014. The central reason for my absence was that I relied on a Supreme Court ruling in the same case by Chief Justice (CJ). Duban filed an appeal in the Supreme Court before the trial to review an earlier decision of the Waigani National Court that granted me leave (permission) to amend my petition. The CJ ruled that the full bench of the Supreme Court would first deal with Dubans appeal before the trial in Madang. Unfortunately the National Court was not advised of the Supreme Courts ruling nor was the trial date vacated. My appeal now seeks to reinstate my Petition on the grounds the ruling was unjust taking into account a number circumstances surrounding the case. My apologies I have been busy preparing the appeal over the past few days hence why I have not posted any latest up-dates.
