Advocate’s strike gets HC judges’ support Today a strike has been called by Oudh Bar Association allegedly against the Allahabad High Court Chief Justice’s order directing Justice Dr Satish Chandra to sit in Lucknow bench. I had to appear In-person in a PIL related with Teacher’s Eligibility Test before the bench consisting of Justice D P Singh and Justice D K Upadhyaya. I reached the Court at the assigned time of 10.15 AM but the bench came only at about 10.35 AM when some members of the Bar stood in the front row and said that there was a strike so that the advocates would not participate. To this, the two Judges readily agreed and before I could reach the front row, they left the Court room within few minutes. I then met Justice D P Singh in his chamber praying that my case might be heard but he refused saying that he was issuing a general order for all the cases and hence he cannot hear my case. After this I had no option that to come back. The Supreme Court has repeatedly said, including in Ramon Services and Ex-Capt. Harish Uppal case, that if a lawyer goes for strike, he commits a criminal offence and interferes with the administration of justice and commits contempt of Court. It has also been said that Courts are under an obligation to hear and decide cases brought before it and cannot adjourn matters merely because lawyers are on strike. Yet my prayer for hearing was refused. I have immediately faxed the entire matter to the Chief Justice of the Supreme Court and the High Court, seeking enquiry and appropriate action in this case. Is the judicial system going to improve in this way?
