After 3 hours of hearing testimonies from the hospital staff along with Mrs. Earlas friends the restraining order was lifted so her son can visit and contact her by phone which also includes her friends and families. Cape Fear Hospital had 2 teams of attorneys for a minute I thought OJ Simpson was somewhere in the courthouse. Mrs. Earlas son didnt do anything I wouldnt have done myself. Mrs. Earla was admitted to Cape Fear due to a seizure and her son did ask the Drs what kind of medications they were giving her and actually requested to have his mother transferred to another hospital. The medical team took it as if he was interfering with her medical treatment , and thats when then hospital took it upon themselves and filed for her power of attorney. Craig would call his mother just to see how she was doing and the hospital kept up with how many times he contacted her and testified that he had been calling more than 3xs a day. Listening to their testimonies I thought for a minute that I was caught up in the middle of a Alfred Hitchcock movie I could not wrap my brain around any of this. I had spoken with Mrs. Earla everyday for the last 35 days of her hospital stay and still to this day I have no idea why they are keeping her this long and all she can say is why cant I go home? I have known Mrs. Earla and her family for 30 plus years and even though she is 85 years young her mind is just as sharp as a tack. I was on the stand for about 45 minutes answering every question that they asked and they gave me the opportunity to add a few thoughts if I had some. I looked at the hospital attorneys and her nurses and said you have known Mrs. Earla for 30 plus days and I have known her for 30 plus years and she is far from being incompetent. Her son Craig isnt doing anything that most of us wouldnt do. Who cares how many times he calls thats his mother doesnt he have that right? Doesnt she have the right to put on her pajama bottoms instead of laying in the bed with nothing on but a hospital gown and has been like that since she was admitted. Mrs. Earlas attorney is just about as confused as I am as to why and how something like this can happen in this great county that men and women have fought for our freedom. I dont know what is going on in Fayetteville but my testimony today did make a impact because they did lift the restraining order so he can visit and speak with his mother. It is a childs place to look after our parents when they get to where they cant care for themselves it is our responsibility in my opinion. Mrs. Earla and her aunt was on Nash Street since I was a child and most know Mrs. Mamie and they reside beside Lelon Winsteads home and across from Mr. Mullen (the shoe man) and I would visit those sweet ladies all the time. A lot of things have changed and some for the better and some for the worse, but I never thought I would live to see the rights stripped from the elderly. Please continue to keep Mrs. Earla in your prayers and pray the hospital will release her so she can enjoy the rest of her days in her own home. There is another court date scheduled next week to determine if she can be released. This type of authority that the hospital can take upon themselves to make this kind of decisions should be unlawful. Who even knew that this existed?
