BIR urges public support on “Oplan Kandado” campaign BY BOY RYAN B. ZABAL The Bureau of Internal Revenue (BIR) here is asking the public to help report erring business establishments under its nationwide “Oplan Kandado” program. The intensified crackdown against tax evaders will also redound to the benefit of the public in terms of government services and infrastructure projects, according to BIR Aklan revenue district officer Ricardo Osorio, Jr. Last July 9, a Korean restaurant in Barangay Pook in Kalibo, Aklan was temporarily padlocked for alleged violations of tax regulations. The restaurant near the Kalibo International Airport terminal is owned and operated by a Filipina lady. Osorio said the restaurant under-declared its sales by more than 30 percent for the taxable quarter and failed to properly register as a Value Added Tax (VAT) taxpayer despite having breached the P1.5 million threshold amount in annual gross sales. “The business, registered on August 2012 as percentage taxpayer, failed to refute the findings of BIR and to convince us that we had errors in the assessment of taxes,” he said. Osorio said the local BIR conducted overt surveillance for 10 days after it received complaints for non-issuance of official receipts. He added the BIR issued two notices before they implemented the closure but the establishment still failed to comply. Osorio said the restaurant resumed its operations also last week after it paid about P760,000 tax obligations in the bank. On January 2009, BIR issued Revenue Memorandum Order (RMO) No. 3-2009 to implement the “Oplan Kandado” Program, where business operations of non-compliant taxpayers will be suspended and their establishments will be temporarily closed if they will be found to have violated certain tax laws. The program aims to intensify the BIR’s enforcement operations through strict imposition of prescribed administrative sanctions for noncompliance with the basic tax requirements.
