BOE Member Karen Belanger Violate New York State Privacy Laws? On May 9, at the BOE Forum, Karen Belanger made the following statement in a public, televised forum: “”a great deal of information will be shown to the appropriate parties under the 3020(a) hearing process that Ms. Coppola, presumably, will be shortly going through AND HOPEFULLY WE WILL BE ABLE TO ORGANIZE THE SAME THING FOR MS. MEHLER.” Ms. Coppola and Ms Mehlers supporters claim this statement is a flagrant violation of New York State and Federal Privacy Laws, is actionable, is a violation of NYS Penal Law OFFENSES AGAINST THE RIGHT TO PRIVACY - Penal Law Articles 250.00 thru 250.65; New York State Civil Rights Law - Article 5 | Right of Privacy; Title N - NYS Penal Law - Offenses Against Public Order; Part 3 - New York State Penal Law - Specific Offenses; and 5 U.S.C. Sec. 552a(g). In the case of criminal violations of the Act (Section 3 of the Act, 5 U.S.C. Sec. 552a(i) limits these so-called penalties to misdemeanors), an officer or employee of an agency may be fined up to $5,000 for: A.Knowingly and willfully disclosing individually identifiable information which is prohibited from such disclosure by the Act or by agency regulations; orB. Willfully maintaining a system of records without having published a notice in the Federal Register of the existence of that system of records. Ms. Coppola and Ms Mehlers supporters claim that where Karen Belanger states HOPEFULLY WE WILL BE ABLE TO ORGANIZE THE SAME THING FOR MS. MEHLER, clearly she is referring to charges to be brought and a subsequent 3020(a) hearing process that violates Mrs. Mehler right to privacy, where Karen Belanger “hopes” the same fate awaits Plaintiff Mehler she clearly reveals conversations that occurred during private executive sessions, and she does so in a televised, public form. https://facebook/RyeCityRoundup
