Border Patrol Corruption (11-6-14) ~ https://youtube/watch?v=yhtDTOHigcg 81,882 - views I am pretty sure my rights were infringed upon at the Hwy 281 Border Patrol Checkpoint just south of Falfurrias, Texas (27.025054, -98.138415). I apologize in advance for not being perfectly on point with my retorts. Please share with others. If you would like to help: gofundme/TSvsCorruption Alright, There is clearly an overwhelming number of people that do not understand my motive to resist this INTERIOR CHECKPOINT. You are either a member of a biased community, such as law enforcement, or perhaps another form of government employee. Id like to begin by saying that your negativity is irrelevant. Different opinion are 100% encouraged but disrespect will not be tolerated. To begin, I will cite the 4th Amendment. The Fourth Amendment originally enforced the notion that “each man’s home is his castle”, secure from unreasonable searches and seizures of property by the government. It protects against arbitrary arrests, and is the basis of the law regarding search warrants, stop-and-frisk, safety inspections, wiretaps, and other forms of surveillance, as well as being central to many other criminal law topics and to privacy law. Amendment IV The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. This is what I tried to explain to the agent. 18 U.S. Code § 111 - Assaulting, resisting, or impeding certain officers or employees (a) In General.— Whoever— (1) forcibly assaults, resists, opposes, impedes, intimidates, or interferes with any person designated in section 1114 of this title while engaged in or on account of the performance of official duties; or (2) forcibly assaults or intimidates any person who formerly served as a person designated in section 1114 on account of the performance of official duties during such person’s term of service, shall, where the acts in violation of this section constitute only simple assault, be fined under this title or imprisoned not more than one year, or both, and where such acts involve physical contact with the victim of that assault or the intent to commit another felony, be fined under this title or imprisoned not more than 8 years, or both. I would cite United States v. Martinez-Fuerte, 428 U.S. 543 (1976), but i never denied that cases validity, and I specifically said he was allowed to ask questions, I just do not have to answer them. This is the only basis that the agent tried to use to detain me. As invalid as his basis was, even if he managed to actually find a way to properly execute this, it is still subordinate to the constitution. 18 USC 111 is also trumped by my right to remain silent, covered under the Fifth Amendment: No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. Through all the actions of this video, you can clearly see that the agents involved did willingly commit to 18 U.S. Code § 242 - Deprivation of rights under color of law, which says: Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both...
