Cassation Orders Couple To Pay Back KD 175K For Violating Contract Terms The Court of Cassation upheld Appeals Court’s verdict that obliged a citizen and his wife to pay back KD 175, 000 for violating the terms of a contract after selling a farm to the plaintiff in the Sultanate of Oman. Plaintiff Attorney Mohammed Al- Majidi said the wife owns realestate firm and the husband is empowered to sign on her behalf, thus they sold a farm worth KD 175,000 to his client in the Sultanate of Oman, which he paid in two cheques, but the defendants broke the terms of contract. Meanwhile, Commercial Section at the Court of Appeals ordered a trading company to pay KD 10,550 to a contractor for a job performed without payment. On behalf of the contractor, Lawyer Mohammad Al-Fadhli sued the company for refusing to pay his client after he had executed specific tasks, even as the company acknowledged the job has been implemented. The lawyer presented relevant agreements duly signed by the engineer and general manager of the company. As a result, the court applied Article 13 of the Constitution stipulating that paper agreement is a tenable document and the person involved must oblige the payment of value therein.
