DECEASED WORKERS FAMILY SUES MCM FOR K548,000 THE family of a Mopani Copper Mines crusher operator who died while placing an explosive charge in the crusher chute in Mufulira in January has sued the mining company, claiming over K540,000 as compensatory damages. In this matter, Hildah Nachalwe, the plaintiff and administrator of the estate of the late Wordy Sichalwe has sued Mopani and is claiming damages for those that depended on Sichalwe, interest and costs. Nachalwe has argued that Sichalwe, 31 died whilst on company duty. According to a statement of claim filed in the Lusaka High Court principal registry, Nachalwe stated that on or about January 6, 2014 in the course of his employment, Sichalwe was assigned to work on a project at the employers Mufulira mine 1062 metre level. She submitted that on the fateful day, Sichalwe was placing an explosive charge in the crusher chute in order to dislodge a hang-up- by conducting secondary blasting. Nachalwe explained that in the process of operations, the charge detonated prematurely thereby causing fatal body injuries to Sichalwe. She stated that the claim for damages was meant for three of the deceaseds children who were at Eagle International School and Joy Pre-School, as well as his widow. Nachalwe also stated that the deceased was a healthy and happy man aged 31 and used to earn K2,880.84 per month from his employment at MCM. She stated that the deceaseds dependants lost their means of support and suffered loss and damage. She further observed that failure by MCM management to maintain a safe working system was potentially dangerous to the workmen. Nachalwe also stated that failure by the defendants to put up mechanisms that would allow the operator crusher to work safely was an indication that the scene was potentially dangerous.
