There are things you need to know about Xiph.org.... 1) The whole organization is built around an alternative to MP3 Codecs called Ogg Vorbis WHICH IS USED AS THE CORE STREAMING TECHNOLOGY FOR SPOTIFY. 2) THEYRE ANTI-COPYRIGHT, and have utopian visions of a post-copyright music distro system that completely misunderstands ANY of the time-tested ways that musicians and publishers have worked so well together historically to build sustainable careers. 3) Their desire to be anti-192k seems linked to their desire to promote streaming technology as the platform for recorded music, and their TECHNOLOGY VIDEOS ARE CLEARLY TIED TO THEIR AGENDA TO MAKE SURE NO COMPANY HAS THE RIGHTS TO RECORDED MUSIC IN ANY EXCLUSIVE FORMAT, despite so many musicians need/desire/reliance on partnerships with companies for the success of their careers. Why be so mad about 192k? Because thats just making people pay for music - which would go against Spotifys model, which uses their technology. 4) The open-source license that Ogg Vorbis uses is called a BSD and contains this handy little bit of leverage: The BSD License allows proprietary use and allows the software released under the license to be incorporated into proprietary products. Works based on the material may be released under a proprietary license as closed source software. Which is to say that the mechanism for Spotify to be paying Xiph.org is there in the license agreement.
