MWSLCB released its recommendations on how to proceed with medical and recreational marijuana. The results are VERY problematic for patients. Particularly problematic areas include: -Forced Expiration on all EXISTING authorizations upon full implementation of I-502, (which could seriously restrict access to some patients, while eliminating necessary access to many others altogether) -ELIMINATION OF THE AFFIRMATIVE DEFENSE PROVIDED IN RCW 69.51A, (protecting patients from criminal prosectution) -ELIMINATION OF ALL COLLECTIVE GARDENS!!! (All Operating Dispensaries) -Dropping patient possession limits from 24 oz to 3oz -Elimination of the ability to add qualifying conditions via the petition process -Significantly tighten language around current qualifying conditions, making only the most debilitating qualify -Elimination of All Home Grows -Eliminate the provision in RCW 69.51A.045 that grants qualified patients or designated providers an affirmative defense to criminal charges of possession above the legal amount if they can prove at trial the patient’s necessary medical use exceeds the amount determined in law.
